Welcome to Woolmandu (https://woolmandu.com). These Terms and Conditions (“Terms”) govern your use of our website (the “Site”) and the purchase of our products. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Site.
These Terms constitute a legally binding agreement between you (the “Customer”) and Woolmandu, with a registered address at Bijlmerplein 885 B2, 1102MG Amsterdam, Netherlands (“we,” “us,” or “our”).
1. Eligibility and Account Registration
- By placing an order, you warrant that you are at least 18 years old or have parental consent to make a purchase, and that you are legally capable of entering into binding contracts.
- If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Products, Pricing, and Descriptions
- Handmade Variance: Our products are crafted by hand in Nepal. Due to the artisanal nature of woolen products, slight variations in color, texture, sizing, and design are natural characteristics and are not considered defects.
- Pricing: All prices are subject to change without notice. Depending on your browsing location, prices may be displayed in your local currency.
- Taxes and Customs Duties: * For orders delivered within the European Union (EU), prices are inclusive of statutory VAT where applicable.
- For international orders outside the EU (e.g., US, Canada, Australia, New Zealand, UK), you are the importer of record. Your order may be subject to local import duties, customs fees, and taxes levied once the shipment reaches your country. These charges are the sole responsibility of the customer.
3. Orders and Payments
- Order Acceptance: Receipt of an electronic order confirmation does not signify our final acceptance of your order. We reserve the right to cancel or limit any order for reasons including, but not limited to, product unavailability, pricing errors, or suspected fraudulent activity. If your payment has already been processed and we cancel the order, a full refund will be issued immediately.
- Payment Gateways: We accept multiple payment options globally and locally to process your transactions securely:
- Global Options: Stripe, PayPal, Major Credit/Debit Cards, Apple Pay, Google Pay, and Klarna.
- Nepal-Only Local Options: Fonepay, Khalti, and eSewa.
- By providing payment details, you confirm that you are authorized to use the designated payment method.
4. Shipping and Delivery
- Delivery Timeline: We ship our products globally. The estimated delivery window for international orders is a maximum of 14 business days from the date of dispatch, unless custom delays or force majeure events occur.
- Shipping Address: You are responsible for providing an accurate and complete shipping address. We are not liable for packages delivered to incorrect addresses provided by the customer or for items held or delayed by local customs authorities.
5. Right of Withdrawal, Returns, and Refunds
Our return policy is strictly structured to comply with international consumer protection frameworks, specifically distinguishing between regional legal mandates.
A. Right of Withdrawal for EU & UK Customers (14-Day “Cooling-Off” Period)
- If you reside in the European Union or the United Kingdom, you have a statutory right to cancel your purchase for any reason within 14 days from the day you (or a third party designated by you) physically receive the goods.
- This statutory right applies to all items, including sale and promotional items.
- To exercise this right, you must inform us of your decision via an unequivocal statement emailed to [email protected] before the 14-day window expires.
- Return Shipping (EU/UK Change of Mind): For standard “change of mind” returns under this window, the customer is responsible for covering the direct cost of returning the goods to our specified return address. Items must be returned unworn, unwashed, and in their original packaging.
B. Standard Returns for Non-EU/UK Customers (US, Canada, Australia, New Zealand)
- For customers outside the EU and UK, we offer a 7-day return window from the date of delivery for an exchange or store credit, provided the items are in their original, unused condition. Clear clearance or final sale exclusions may apply to these regions as permitted by local law.
C. Faulty, Damaged, or Incorrect Items (Global Consumer Guarantees)
- Regardless of your geographic location, if an item arrives faulty, damaged, or significantly not as described, local consumer laws apply (including the Australian Consumer Law, UK Consumer Rights Act, and EU Consumer Sales Directive).
- In such cases, you must contact us immediately at [email protected] with photographic proof of the defect.
- Resolution: Upon validation, Woolmandu will provide a full refund of the purchase price, including original shipping charges, or offer a free replacement. Woolmandu will cover all return shipping costs for verified faulty or defective items.
6. Limitation of Liability
- To the maximum extent permitted by applicable law, Woolmandu shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Site or products purchased through the Site.
- Our total liability for any claim arising out of a purchase shall not exceed the actual purchase price paid by you for the specific product in question.
7. Intellectual Property
- All content on this Site, including text, logos, graphics, images, product descriptions, and software, is the exclusive property of Woolmandu or its content suppliers and is protected by international copyright, trademark, and intellectual property laws. You may not reproduce, distribute, or modify any content without our explicit written permission.
8. Governing Law and Dispute Resolution
Because Woolmandu operates across international boundaries with legal footprints in both Asia and Europe, these Terms are governed by a dual-jurisdiction structure:
- Domestic Operations & Crafting: For operations and actions localized to our manufacturing origins, the laws of Nepal apply.
- E-Commerce, Digital Infrastructure & EU Distribution: For digital transactions, European consumer interactions, and operations managed from our distribution base, the laws of the Netherlands apply.
- Any disputes arising from these Terms that cannot be settled amicably shall be submitted to the competent courts of Kathmandu, Nepal, or Amsterdam, Netherlands, depending on the legal nexus of the claim.
- EU Online Dispute Resolution: If you are an EU resident, you may also choose to raise a dispute via the European Commission’s Online Dispute Resolution (ODR) platform at
https://ec.europa.eu/consumers/odr.
9. Severability and Complete Agreement
- If any provision of these Terms is deemed unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
